Pepper EU Privacy Policy for Applicants

We know that it is important to you how we use your personal data and appreciate your trust in us that we treat it carefully and conscientiously. This Privacy Policy explains how we collect, use and share (collectively “process”) the personal information of our applicants.

Who is responsible for the processing of your personal data?

The Pepper Media Holding GmbH, Torstr. 164, 10115 Berlin (hereinafter referred to as “we”), is responsible within the meaning of the EU General Data Protection Regulation “DSGVO”).

For what purposes and on what legal basis do we process personal data?

We process personal data about you for the purpose of your application for employment, as far as this is necessary for the decision to establish employment with us. The legal basis is § 26 Abs. 1 i.V.m. Abs. 8 S. 2 BDSG.

Furthermore, we may process personal data about you, as far as this is necessary to defend against asserted legal claims from the application process against us. The legal basis is Article 6 (1) (f) GDPR, for example, the legitimate interest is a burden of proof in proceedings under the General Equal Treatment Act (GETA).

As far as there is an employment relationship between you and us, according to § 26 Abs. 1 BDSG we may further process the personal data already received from you for employment purposes.

Which categories of personal data do we process?

We process data related to your application. This may include general personal information about you (such as name, address and contact details), information about your professional qualifications and education, or other information that you provide to us in connection with your application. Incidentally, we may process your publicly available job-related information, such as a profile in professional social media networks.

Is data shared with third parties?

Companies of our corporate group

Personal data are disclosed only under certain conditions and within the legally permissible limits within the companies of Pepper Media Holding GmbH, for example to a limited number of members of the Human Resources or IT department, who may each be employed by several companies. Whenever we need to share your personal information, we do so only on a “need to know basis” and only to certain employees to perform in their area of ​​responsibility. Pepper takes the necessary measures to ensure confidentiality in the handling of your personal data.

Service provider

We use the services of third parties (eg BambooHR, Lindon, UT 84042-1911, USA, as our Applicant Tracking System). If necessary, your personal data will be processed by the respective service provider on behalf of Pepper Media Holding GmbH as part of the service relationship.

We confirm for any third party acting on our behalf that they can sufficiently guarantee the security of your personal data and that they are processed confidentially.

Transfer to third parties

Under certain circumstances, we share (or are required to) your personal information with third parties outside the companies of Pepper Media Holding for the purposes listed above. This always takes place in compliance with the applicable data protection regulations. The respective third parties act on their personal data independently as a “responsible body” and are responsible for the observance of applicable data protection regulations.

How long will your data be stored?

We store your personal information as long as this is necessary to make a decision on your application. Insofar as an employment relationship between you and us does not materialize, we may also continue to store data as far as it is necessary to defend against possible legal claims. The application documents will be deleted two years after notification of the rejection decision, unless a longer storage due to litigation is required.

Which rights do you have?

You have the right to request access to or correction or deletion of your personal data or data transmission. Furthermore, you are entitled to object to the processing of your personal data in certain cases. In case of your consent to the use of your personal data by us, you are entitled at any time to revocation with effect for the future. No automated decision-making

There is no automated decision in individual cases within the meaning of Art. 22 GDPR, that is, the decision on your application is not based solely on automated processing.
